Trump has fiercely opposed the attempts to remove him from office, claiming that they violate his constitutional rights and that only a congressional act could bring the 14th Amendment’s guarantee into effect. 

Despite the fact that courts in states like Florida, Michigan, and Minnesota have already decided in favour of Trump’s continued candidacy, CREW, Free Speech for People, and other plaintiffs have launched a number of cases around the nation opposing his candidacy. 

Nonetheless, judges in Michigan and Minnesota indicated that cases might be reopened for the general election, concluding that they are unable to specifically remove Trump from the primary ballot. Twelve states still have open challenges to Trump’s candidacy, according to a Lawfare tracker.

The 4-3 Decision will be Postponed Till?

The 4-3 decision will be postponed until January 4 in anticipation of Trump’s appeal to the US Supreme Court, which might resolve the issue for the whole country. The historic decision by the state Supreme Court will shake up the 2024 presidential race, even if it only applies to Colorado. 

The Republican primary is slated for March 5, and Colorado election authorities have stated that a resolution to the dispute must be reached by January 5, the statutory deadline for establishing the field of candidates.

Trump Statement About 14th Amendment

Democrats’ attempts to sabotage Trump’s 2024 campaign by using the 14th Amendment as “another trick,” according to the president.

Earlier this week, Trump posted on social media, saying, “Nearly all legal scholars have voiced opinions that the 14th Amendment has no legal basis or standing relative to the upcoming 2024 Presidential Election.”

Though legal experts argue the criminal prosecutions have little to do with whether the 14th Amendment may be applied, Trump is facing four indictments, including two sets of accusations related to his attempts to rig the 2020 elections. Ultimately, it is worth noting that anyone found guilty and imprisoned may still stand for president.

At Least Two Secretaries of State Said Trump Won’t be Removed

Trump won’t be removed on the ballot by themselves, according to at least two secretaries of state. Adrian Fontes of Arizona said that he is prohibited from executing Section Three based on a state supreme court decision.

Brad Raffensperger of Georgia stated that the electorate should determine whether or not to elect Trump. In a Wall Street Journal piece last week, he stated, “Denying voters the opportunity to choose is fundamentally un-American.”

Secretary of State Jena Griswold of Colorado, for her part, stated that she will monitor the current litigation in the state and added that election authorities may find advice from the court case.

“This is an atypical circumstance. Griswold told Politico, “We’ve never seen a president so openly threaten our democracy and inspire an uprising.
